Tiltworks Privacy Policy

Tiltworks NC, Inc. ("Tiltworks" or "we" or "us") owns and operates this website (this "Site") which is generally intended for use by independent contractors ("Contractors" or "you") who are performing services for us. If you are using this Site, it will typically be in connection with a contract (a "Contractor Agreement") that we have awarded to you or to your employer. We recognize that you may be concerned about our treatment of the personally identifiable information ("Information") that you provide to us on this Site. Accordingly, this privacy policy (this "Policy") addresses those concerns and both describes the Information that we may collect and explains how we will use your Information.

You should note that when you leave this Site, whether via a link provided by us or otherwise, you may enter a site owned and controlled by a third party ("Third Party Sites"). Accordingly, this policy does not apply to any Information that you share on Third Party Sites. Before disclosing Information, you should verify that you know the identity of the party to whom you are making a disclosure and the privacy policy that applies to the treatment of your Information.

Please understand that your use of this Site is also governed by the terms of the Contractor Agreement to which you or your employer are a party and, in the event of any conflict between the terms of this Policy and such Contractor Agreement, the terms of the Contractor Agreement will control except as prohibited by law.

In addition, your use of this Site is also governed by the terms of our Terms of Use.

Information Not Covered by this Policy

This Policy does not apply to any public areas of this Site or any other Site that we may own or operate. By using this Site, you acknowledge that you understand that this Site is intended to foster efficient and effective communication between our independent contractors and us. To the extent that you disclose Information in any portion of our Site that can be viewed by the public or other registered users, including other independent contractors, or you disclose Information directly to another user, you understand that such disclosures do not fall under the scope of this Policy and you make such disclosures at your own risk. If you submit materials to us that we own in accordance with an applicable Contractor Agreement, those materials are also not subject to this Policy and we reserve our right to do anything with those materials in our discretion. In addition, this Policy does not apply to, and Tiltworks has no responsibility for, any Information that you transmit directly to another person via the Site.

You also should understand that to the extent you provide us with Information in connection with your submittal of a bid for a particular project or your performance of services pursuant to a Contractor Agreement, all such materials may be shared with our client, in our discretion.

1. Information Collection and Use

In order to effectively use this Site, you may be asked to register as a user. As part of the registration process, you will be asked to disclose certain Information, including your name, Email address, mailing address, phone number, and such other information that we may reasonably require. For example, in order to submit ideas to us and to participate in available open call and evergreen projects, you will necessarily be required to register to use the T-hive Tiltworks hub, a portion of this Site that is essential to the administration of our projects.

We also automatically receive and record other non-personally-identifying information ("Non-Personal Information") on our server logs from your browser even if you do not register as a user of this Site. For example, we will keep a record of your IP address, certain cookie information, and the pages you visit but such Non-Personal Information will not be linked or in any way connected to your Information. We will use your Non-Personal Information for the improvement of our services and this Site, to conduct research, to provide anonymous reporting for internal and external clients, and for other business purposes. Please refer to section 3 of this Policy for more information on how we may collect Non-Personal Information.

If you register on this Site, we may use your Information to contact you about your use of the Site and the services that you are either providing to us or that you may wish to provide to us. We may also contact you to inquire as to your interest in providing to us certain services that you may not yet have offered to perform for us.

2. Information Sharing and Disclosure

When you perform certain services for us in connection with projects for our clients, you will be asked to upload certain data, including (i) materials that we have paid you to develop and deliver, (ii) biographical information, (iii) project specifications, and (iv) such other useful data requested on the Site that will maximize your performance of your obligations pursuant to a Contractor Agreement (collectively, "Site Criteria"). Unless we have your prior written permission to do so, we will not disclose any of your personally identifiable information to any third party. To the extent that the Contractor Agreement applicable to you includes negotiated specific terms regarding such disclosures, the terms of such Contractor Agreement shall govern such disclosures.

We may also disclose your Information to third parties if we have your consent to do so or if such disclosure is necessary in connection with your use of the Site.


Although unlikely, in certain instances we may disclose your contact Information when there is reason to believe that it is necessary to identify, contact or bring legal action against persons or entities that may be causing injury to you, to us or to others. We may also disclose your Information when we believe the law or legal process requires it.

In addition, if Tiltworks merges into any other entity or is otherwise involved in any business combination in which it is not the surviving company, Tiltworks will share your Information with the surviving entity only if the surviving entity has agreed to comply with the terms of this Policy.

3. Cookies and Web Beacons

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site and we may link your Information to cookies.

We use both session ID cookies and persistent cookies. We use session ID cookies to make it easier for you to navigate our site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s "help" file. For example, we set a persistent cookie to store your password, so you don’t have to enter it more than once.

If you reject cookies, you may still use our site, but your ability to use some areas of our site will be limited.

Tiltworks utilizes tracking technology to better understand site traffic patterns and use. However, none of the information collected via tracking technology is personally identifiable information.

The use of cookies by our customers and other third parties whose websites you may access from this Site is not covered by our privacy statement. We do not have access or control over these cookies.

Tiltworks may use web beacons in connection with e-mails sent to Tiltworks.com users, to let us know whether and when the email was opened. No personal information is transmitted through web beacons.

4. Confidentiality and Security

We follow generally accepted industry standards to protect the Information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your Information, we cannot guarantee its absolute security. Once we receive your Information, we will store it behind our firewall. Our management team and its engineers regularly review and update the integrity of this Site and the security of your Information. Tiltworks cannot, however, safeguard any data stored on your own personal computer or any public computer upon which you might elect to access this Site.

5. Your Ability to Edit and Delete Your Account Information

You may correct, update, or amend your Information by requesting the desired changes on your account profile page. We will respond to your request within ten (10) business days.

6. Certain Users

This Site is intended for use by users in the United States and is consequently directed towards residents of the United States. You may not use this Site if such use is prohibited by applicable law, rule or regulation.

This Site is also intended for use by users who have reached at least the age of eighteen (18) years. If you are under the age of eighteen (18) you should use this Site only with the approval and assistance of your parent or guardian.

9. Applicable Law, Venue, Jurisdiction

This Policy shall be governed by the laws of the State of North Carolina without regard to any provision of its laws which would require the application of the laws of a different jurisdiction. For any dispute arising under this Policy, you agree to submit to the personal and exclusive jurisdiction of the federal and state courts located in Buncombe County, North Carolina. You further agree to accept service of process by mail, and hereby waive any and all jurisdictional and venue defenses otherwise available. To the extent permitted by applicable law, you hereby waive any right to trial by jury in connection with any dispute arising out of or relating to this Policy, between you and Tiltworks, its affiliates, and their respective officers, directors, owners, and agents.
